These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or
"Customer") and Lydyoung LLC, doing business as "LensIQ" ("LensIQ," "we," "us," or "our"), governing your use
of the LensIQ website, dashboard, and related services (the "Service"). By creating an account,
connecting your eBay account, or using the Service, you agree to these Terms. If you do not
agree, do not use the Service.
⚖️ PLEASE READ — ARBITRATION & CLASS-ACTION WAIVER. Section 19 requires most disputes to be
resolved by binding individual arbitration and **waives your right to a jury trial and to
take part in a class action. You may opt out within 30 days** of first accepting these
Terms (see Section 19). Please read Section 19 carefully.
You must be at least 18 years old and able to form a binding contract. If you use the Service
on behalf of a business, you represent that you are authorized to bind that business to these
Terms.
LensIQ is an analytics tool for eBay sellers. We connect to your eBay account (with your
authorization) and provide reporting and insights about your sales, returns, listings, brands,
categories, sizes, colors, buyer trends, and related metrics. Some features use automated and
AI-based methods to estimate information (such as brand and category) from your listing titles.
You are responsible for the activity under your account and for keeping your login credentials
secure. Notify us promptly of any unauthorized use. We are not liable for losses caused by your
failure to safeguard your account.
We may offer a free trial period (for example, your first 90 days). At the end of the trial,
paid features require a purchase or subscription as described in Section 5. We may change or
end trial offers at any time.

All fees are final and non-refundable. The AI engine processes your data and incurs costs
the moment you purchase, so we do not offer refunds, credits, or exchanges for any payment,
including unused time on a subscription. By purchasing, you acknowledge and agree to this
no-refund policy. This does not limit any rights you may have that cannot be waived under
applicable law.
You may cancel at any time from your account settings. Cancellation stops all future charges,
and you keep access to paid features through the end of your current billing period. We do not
provide prorated or partial refunds for unused time.
Authorization. To provide the Service, you authorize LensIQ to access, retrieve, process,
and store data from your connected eBay account — including your listings, orders, returns, and
related transaction details — on your behalf. You confirm you have the right to share this
data with us, and that doing so does not violate eBay's terms or any law.
Storage & retention. We store this data so the Service can analyze it and so your records
are preserved even if eBay later removes them. We retain your data for as long as your
account is active and for a reasonable period afterward. You may request deletion of your data
at any time by contacting us, and we will delete it except where we are required to keep it to
comply with law, resolve disputes, or enforce our agreements.
eBay-directed deletion. If eBay notifies us that you have closed your eBay account, or that
your information must be deleted (an eBay Marketplace Account Deletion/Closure notification), we
are required to delete all eBay data we hold about you, and we will do so. Because the
Service cannot operate without that data, **we reserve the right to terminate your subscription
and revoke your access to LensIQ effective on the day we receive and verify such a notification
from eBay**, without prior notice and without refund. This obligation overrides any
data-retention choice or preference you may have selected. When we close your account this way,
we delete **all data associated with your LensIQ account — including any Poshmark, Mercari, or
Depop data you have added — not only your eBay data.** Your entire account and all of its data
are removed.
Our right to terminate and delete. In addition to the above, **we reserve the right, at our
sole discretion and for any reason, to suspend or terminate your account, end your subscription,
and delete all data associated with your account** (across every connected platform), with or
without notice. We are not liable to you or any third party for doing so.
Use. We use your data to operate and provide the Service to you. We may also use
de-identified, aggregated data (which does not identify you or your buyers) to maintain and
improve our detection engine and the Service. We do not sell your personal data. Our
collection and handling of personal information is further described in our Privacy Policy.
Your ownership. As between you and us, your underlying store data remains yours. You grant
us a limited license to host, process, and display that data solely to provide the Service.
LensIQ is an independent tool. **We are not affiliated with, endorsed by, sponsored by,
certified by, or otherwise associated with eBay, Poshmark, Mercari, or Depop.** "eBay,"
"Poshmark," "Mercari," and "Depop" are trademarks of their respective owners, and all related
marks are the property of those owners; we reference them only to describe the marketplaces
LensIQ supports. LensIQ connects to your eBay account through eBay's official API, accessed
solely with your authorization. Poshmark, Mercari, and Depop data is provided by you via
report upload (LensIQ does not connect to those platforms directly). The Service depends on
these platforms' APIs, files, and policies, which they may change, limit, or discontinue at any
time. We are not responsible if a platform changes its API, export format, rate limits, data
retention, or your access, and such changes may affect or disable features without notice.
Brand, category, size, color, and similar values are estimates produced by automated and
AI-based methods reading your listing titles and item details. They are **not guaranteed to be
accurate or complete**, and accuracy figures we publish are rough estimates from our own
testing, not promises. You are responsible for verifying any information before relying on it
for business decisions. We do not guarantee any particular sales, profit, or business result.
You agree not to: (a) use the Service unlawfully or in violation of eBay's policies; (b) copy,
scrape, resell, sublicense, or redistribute the Service or its data except as allowed; (c)
reverse-engineer or attempt to access source code except where permitted by law; (d) interfere
with, overload, or disrupt the Service; or (e) use the Service to access data you are not
authorized to access. We may suspend or terminate accounts that violate this Section.
The Service, including its software, design, text, and trademarks, is owned by LensIQ and
protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to
use the Service for your internal business purposes while your account is active. You receive no
other rights.
Feedback. If you send us ideas, suggestions, or feedback about the Service, you grant us a
perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose, with no
obligation or compensation to you, and we have no duty to keep feedback confidential.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED,
ERROR-FREE, SECURE, OR THAT DATA WILL BE ACCURATE OR ALWAYS AVAILABLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LENSIQ WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL,
SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SALES, LOST DATA, OR
BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM
WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM, OR
(B) US $50.
You agree to indemnify and hold LensIQ harmless from any claims, damages, or expenses
(including reasonable legal fees) arising from your use of the Service, your data, or your
violation of these Terms or any law or third-party right.
You may stop using the Service and delete your account at any time. We may suspend or terminate
your access if you violate these Terms, fail to pay, or if we discontinue the Service. On
termination, your license ends; Sections that by their nature should survive (including 6, 8,
10, 13, 14, 15, and 19) will survive.
We may modify the Service or these Terms at any time. If we make material changes to the Terms,
we will provide notice (for example, by posting the updated Terms with a new date or by email).
Your continued use after changes take effect means you accept the updated Terms.
Payments are processed by Stripe. By purchasing, you also agree to the
payment processor's terms. We do not store full payment card numbers.
These Terms are governed by the laws of the State of Pennsylvania, without regard to conflict-of-
law rules. The Federal Arbitration Act governs the interpretation and enforcement of the
arbitration provisions in this Section.
Informal resolution first. Before starting an arbitration or court proceeding, you agree to
contact us at contactleniq@gmail.com and give us 30 days to try to resolve the dispute
informally. Most concerns can be resolved this way.
Binding arbitration. Except for the carve-outs below, any dispute arising out of or relating
to these Terms or the Service will be resolved by final and binding individual arbitration,
administered by a recognized arbitration provider (such as the American Arbitration Association
or JAMS) under its consumer rules, rather than in court.
Jury-trial and class-action waiver. TO THE EXTENT PERMITTED BY LAW, YOU AND LENSIQ WAIVE THE
RIGHT TO A JURY TRIAL, AND AGREE THAT DISPUTES WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND
NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Carve-outs. Either party may (a) bring an individual claim in small-claims court if it
qualifies and stays there, or (b) seek injunctive relief in court to protect intellectual-property
rights.
30-day opt-out. You may opt out of this arbitration agreement by emailing
contactleniq@gmail.com within 30 days of first accepting these Terms, stating your name,
account email, and a clear statement that you opt out of arbitration. Opting out does not affect
the other provisions of these Terms.
Court venue (if arbitration does not apply). If a dispute proceeds in court, it will be
brought exclusively in the state or federal courts located in Montgomery County, Pennsylvania, and you
consent to that venue and personal jurisdiction.
